Section 07

MLS & IDX Property Data

Property listing information displayed on the Service is provided through Internet Data Exchange (IDX) feeds from participating Multiple Listing Services, including the Central Texas MLS. This data is provided exclusively for consumers’ personal, non–commercial use and may not be used for any purpose other than to identify prospective properties consumers may be interested in purchasing.

Accuracy Disclaimer

While we make reasonable efforts to provide accurate and current property information, all data is provided “as is” and is subject to verification by the prospective purchaser. Information regarding square footage, lot size, school district, tax amounts, HOA dues, room dimensions, year built, and property condition is deemed reliable but is not guaranteed. Properties may be subject to prior sale, price change, or withdrawal without notice.

Independent Verification

Buyers should independently verify all property details that are material to a purchase decision, including but not limited to:

  • Property boundaries, easements, and survey information
  • School district attendance zones (subject to change by the district)
  • Floodplain status and insurance requirements
  • Homeowners association rules, fees, and assessments
  • Property tax amounts and exemption eligibility
  • Condition, age, and remaining life of major systems (roof, HVAC, foundation, plumbing, electrical)
  • Permit history and any unpermitted improvements

For active–duty service members and veterans evaluating properties near Fort Hood, we strongly encourage independent verification of any military–adjacent claims such as commute times to gate access points, noise contour zones, and on–post amenity availability.

Section 08

A formal brokerage relationship is established only upon execution of a written representation agreement signed by both parties.

Required TREC Disclosures

Texas law requires real estate license holders to provide consumers with the following disclosure documents. Please review them carefully:

Homevets Realty respects the intellectual property rights of others and expects users of the Service to do the same. If you believe that Content on the Service infringes your copyright, please submit a notice to our designated DMCA agent that includes the following information required by 17 U.S.C. § 512(c)(3):

  1. A physical or electronic signature of the copyright owner or person authorized to act on their behalf.
  2. Identification of the copyrighted work claimed to have been infringed.
  3. Identification of the material claimed to be infringing, with sufficient information to allow us to locate it (URL or specific page).
  4. Your contact information: address, telephone number, and email address.
  5. A statement that you have a good–faith belief that the use is not authorized by the copyright owner, its agent, or the law.
  6. A statement, under penalty of perjury, that the information in the notice is accurate and that you are the copyright owner or are authorized to act on behalf of the owner.

Submit DMCA notices to our designated agent at [email protected] with the subject line “Copyright Infringement.”

You may be liable for damages, including costs and attorneys’ fees, if you knowingly materially misrepresent that Content is infringing. Repeat infringers will have their accounts terminated.

Section 13

Third–Party Links & Services

The Service contains links to third–party websites and services that are not owned or controlled by Homevets Realty, including lender partners, mortgage calculators, mapping providers, MLS feeds, and informational resources. These links are provided as a convenience to you.

We do not control and assume no responsibility for the content, privacy practices, accuracy, or availability of any third–party website or service. We do not warrant or endorse the offerings of any third party. Your interactions with third–party websites and services are solely between you and the third party, and you should review their terms and privacy policies before engaging with them.

Mention of a lender, insurance provider, title company, or other service partner is not a recommendation or endorsement. You are free to choose any qualified provider for any service related to your real estate transaction.

Section 14

Termination

We may suspend or terminate your access to the Service at any time, with or without notice, for any reason—including violation of these Terms, suspected fraudulent activity, or behavior that is harmful to other users or to Homevets Realty.

If you wish to terminate your account, you may do so at any time by emailing [email protected] or by discontinuing use of the Service.

All provisions of these Terms that by their nature should survive termination—including ownership of intellectual property, indemnification, warranty disclaimers, limitations of liability, and governing law—shall survive termination.

Section 15

Disclaimer of Warranties

Your use of the Service is at your sole risk. The Service is provided on an “AS IS” and “AS AVAILABLE” basis, without warranties of any kind, whether express or implied—including implied warranties of merchantability, fitness for a particular purpose, non–infringement, accuracy, or course of performance.

Homevets Realty, its affiliates, agents, and licensors do not warrant that:

  • The Service will be uninterrupted, secure, or available at any particular time or location.
  • Any errors or defects in the Service will be corrected.
  • The Service is free of viruses or other harmful components.
  • Property data, market estimates, valuations, or third–party information are accurate or current.
  • Results obtained from using the Service will meet your requirements.

Some jurisdictions do not allow the exclusion of certain warranties, so portions of this disclaimer may not apply to you.

Section 16

Limitation of Liability

To the fullest extent permitted by applicable law, in no event shall Homevets Realty LLC, its directors, members, officers, employees, agents, contractors, suppliers, or affiliates be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including without limitation lost profits, lost data, loss of goodwill, business interruption, or any other intangible loss, arising out of or in connection with:

  • Your access to, use of, or inability to access or use the Service.
  • Any conduct or content of any third party on or through the Service.
  • Any inaccuracy or omission in property listing data, market estimates, school information, or other Content.
  • Unauthorized access to or alteration of your transmissions or data.

This limitation applies regardless of the legal theory on which the claim is based (contract, tort, negligence, strict liability, or otherwise) and whether or not we have been advised of the possibility of such damages.

In any event, our aggregate liability to you for all claims arising out of or relating to these Terms or the Service shall not exceed one hundred U.S. dollars ($100.00 USD).

Some jurisdictions do not allow the limitation or exclusion of liability for incidental or consequential damages, so portions of this limitation may not apply to you.

Section 17

Indemnification

You agree to defend, indemnify, and hold harmless Homevets Realty LLC and its members, officers, employees, agents, contractors, licensors, and affiliates from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to:

  • Your use of and access to the Service.
  • Your violation of any provision of these Terms.
  • Your violation of any third–party right, including without limitation any copyright, property, or privacy right.
  • Any claim that content you submitted caused damage to a third party.
Section 18

Governing Law & Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict–of–law principles. You agree that any dispute arising out of or relating to these Terms or your use of the Service shall be brought exclusively in the state or federal courts located in Bell County, Texas, and you consent to the personal jurisdiction of those courts.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions of these Terms will remain in full force and effect.

These Terms, together with our Privacy Policy and any other agreements expressly incorporated by reference, constitute the entire agreement between you and Homevets Realty regarding the Service and supersede all prior agreements and understandings.

Section 19

Changes to These Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. When we make material changes, we will update the “Last Updated” date at the top of this page and, where appropriate, provide at least thirty (30) days’ notice through the Service or by email before the new Terms take effect. What constitutes a material change is determined at our sole discretion.

By continuing to access or use the Service after revisions become effective, you agree to be bound by the revised Terms. If you do not agree to the new Terms, you must stop using the Service.
